Terms of Use

These terms of use (“Terms”) apply to an individual (“you” or “your”) use of the Jewish Addiction Community Services Toronto (“JACS”, “we”, “us”, and “our”) website at https://jacstoronto.org/ (the “Website”), the mobile and desktop application and web platform provided by Cliniko to facilitate appointment scheduling with a JACS clinician and provision of virtual clinical therapy via videoconferencing (the “JACS Portal”), videoconferencing application, software, and services provided by Zoom Video Communications (“Zoom”), and the materials displayed or made available through the Website or uploaded to the JACS Portal (“Content”). All of the above collectively are the “Services”.
By accessing or using the Services, you acknowledge that you have read, understand, and agree to be bound by these Terms. If you do not agree, you are not permitted to use the Services.
1. Legal Agreement
The Terms form a legal agreement between you and JACS. This includes substitute decision‑makers under the Health Care Consent Act, 1996, where applicable.
2. JACS Portal and Cliniko
To access the JACS Portal, you will receive an email after completing a registration process with a JACS clinician. JACS uses Cliniko to provide the Portal, and you create your user account through Cliniko. JACS bills for clinical services provided through the Portal.
Use of the JACS Portal requires your consent to Cliniko’s policies and terms. If you do not agree with Cliniko’s terms, you must not use the Portal.
3. Zoom
JACS uses Zoom for online clinical services such as support groups and group counselling. Use of Zoom requires your consent to Zoom’s policies and terms. If you do not agree, you must not use Zoom.
4. Accurate Information
You agree to:
provide true, accurate, current, and complete information; and
maintain and update your information as needed.
JACS may suspend or terminate your access if your information is inaccurate or incomplete.
5. Usernames and Passwords
You are responsible for maintaining the confidentiality of your login credentials for the JACS Portal and Zoom. You are responsible for all activities under your account. Sharing your credentials may result in suspension or termination.
6. Medical Emergency
JACS does not provide emergency services. If you have a medical emergency, call a physician, qualified health care provider, visit your nearest emergency department, or dial 911.
7. No Unlawful or Prohibited Use
You agree not to:
upload or transmit malicious code;
upload content you do not have the right to share;
impersonate others;
violate laws or infringe rights;
use the Services unlawfully;
misuse or exploit the Services.
8. No Health Care Provider Relationship
Use of the Website or Content does not establish a health care provider relationship with JACS.
9. Misuse of Services
JACS may refuse or discontinue Services at any time due to misuse.
10. Privacy and Personal Health Information
Your information is governed by the JACS Privacy Policy. By agreeing to these Terms, you confirm you have reviewed it.
11. Limited Licence
You are granted a limited, non‑transferable, non‑exclusive licence to access and use the Services for personal, non‑commercial use.
12. Software Licence
All software used in the Services is owned by JACS or its licensors (including Cliniko and Zoom). You may not:
reproduce, modify, or transmit the software;
sell, rent, or transfer it;
remove trademarks;
reverse engineer or decompile it.
Software is provided “as is” without warranties.
13. Posted Information
Content on the Website is for informational purposes only and is not medical advice.
14. Fees and Cancellation Policy
Individual, couple, and family therapy sessions: $185 + HST per hour unless otherwise agreed.
Fees must be paid prior to each session.
24‑hour cancellation notice is required except in emergencies.
No‑shows or late cancellations are subject to the full fee.
Fees must be paid within 30 days. After 60 days, JACS may discuss financing options.
Failure to pay may result in termination of Services.
15. No Endorsements
JACS does not endorse any products, services, or procedures unless explicitly stated.
16. Intellectual Property
JACS owns all rights to the Services and Content unless otherwise stated. No rights are transferred to you.
17. Third‑Party Links
The Services may contain links to third‑party sites. JACS is not responsible for their content or policies. Accessing them is at your own risk.
18. Limitation of Liability
Your use of the Services is at your sole risk. JACS and its affiliates are not liable for any damages arising from your use or misuse of the Services.
Maximum liability is $1 CAD.
19. Indemnity
You agree to indemnify JACS and its affiliates from any claims arising from:
your breach of the Terms;
your use or misuse of the Services;
your violation of third‑party rights.
20. Modifications to the Services
JACS may modify or discontinue the Services at any time without liability.
21. Termination
JACS may terminate your access at any time. Restrictions on downloaded materials survive termination.
22. Use Prohibited Where Unlawful
You may not use the Services where prohibited by law.
23. Governing Law
These Terms are governed by the laws of Ontario, Canada. Disputes will be resolved in Ontario courts.
24. Assignment
You may not assign these Terms. JACS may assign its rights without notice.
25. Waiver and Severability
Failure to enforce a provision is not a waiver. Invalid provisions do not affect the remainder of the Terms.
26. Entire Agreement
These Terms constitute the entire agreement between you and JACS.
27. Modifications to the Terms
JACS may modify these Terms at any time. Updated Terms will be posted with a revised date. Continued use constitutes acceptance.
